Colorado Man Files Asbestos Lawsuit on Behalf of Father
Steven Dux, of Colorado, has filed an asbestos lawsuit against 13 companies on behalf of his father. Dux claims that the mesothelioma his father, Andres Martinez, was diagnosed with was wrongfully caused. Martinez was diagnosed with the disease on March 14, 2007, and died November 6, 2007.
The suit claims that from 1952 to 1990, while Martinez worked as a laborer and heavy equipment operator at various locations, he was exposed to and inhaled asbestos fibers. Moreover, the suit claims that Martinez’s exposure was foreseeable and should have been anticipated by the defendants.
Due to the asbestos exposure, Dux alleges that his father became disabled and disfigured, which required him to spend large amounts of money for medical, hospital, and other health services necessary to treat the disease. As a result of his mesothelioma, Martinez experienced great physical pain and mental agony. Furthermore, the disease hindered and prevented Martinez from pursuing employment and as a result he lost large sums of money.
Dux is seeking sums in excess of $50,000 and compensatory damages in excess of $100,000. He is also seeking a large amount of punitive damages to punish the defendants for their wrongdoing in an attempt to discourage similar parties from committing comparable acts of misconduct in the future.

My father was also exposed to asbestos and suffered many, many years from asbestosis. He had much shortness of breath. The coughing he encountered from this was so hard on him. It was hard to watch him try to cough. He lost a kidney and gall bladder from the disease. He also had edma in both legs from toes to knees. As a result and suffering for years he past away on May 2, 2008. It was very painful to watch him suffer for so many years.
Dear Joan. I want to send you my utmost understanding of what your life and the life of your entire family have and are going through. For those of us who are walking dead from this deadly asbestos, millions Joan, just like you, are now waking up to the reality to what was done to them/us.Most of this human poisoning began in 1963 and 80% of this deadly asbestos came from a lil town in Montana called Libby. In 1999, the people and miners learned the truth as to why we are sick and dying. From not being told the truth. Three generations of my family are affected by this. Too late for all of us and each one of us just like you Joan, will live with the repeat of watching and caring and burying our loved one exposed. The only salvation and peace to this horrible,painful way to live before/while you die…is death. It is too late for my children who were born and raised in Libby, they follow me and their mom, in their pain and suffering but to continue allowing human beings into the same environment that is killing millions today and me, is so so wrong…Since 1999, Libby continues to be sold as a safe place to live and raise a family. Since 1999, I have been telling all who will listen to stay away from Libby Mt as Libby is not safe to anything that breathes. God Bless you Joan and your entire family for many walk in the same foot steps, the same pain and suffering and death.Nothing natural about this. This was knowingly done to us. I call it the Libby Holocaust…Now, we ALL must protect those we leave behind, our kids and theirs. No grand kids of mine will ever breathe Libby’s deadly air and I shall leave this place knowing/believing this/my generation servives.
